These Terms of Service ("Terms") govern your use of elitestrategiesconsulting.com and its related pages, forms, events, emails, and text messages (the "Services"), operated by Elite Strategies Consulting Group LLC ("ESCG," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Who may use the Services
You must be at least 18 years old and able to enter into a binding agreement to use the Services.
2. Educational information, not professional advice
Content on the Services, including articles, newsletters, videos, podcasts, events, and resources, is provided for general educational purposes only. It is not legal, tax, accounting, investment, or financial advice, and it does not create a client, fiduciary, or advisory relationship. Real estate investing involves risk, including the loss of capital. Results described by ESCG, Martin Perdomo, or any client are not typical and are not a guarantee of future results. Consult qualified professionals before making investment decisions.
3. Coaching, consulting, and paid programs
Coaching, consulting, events, and other paid programs may be subject to a separate agreement, enrollment terms, or invoice. If those terms conflict with these Terms, the separate agreement controls for that program.
4. Forms, communications, and consent
When you submit a form, book a call, or subscribe, you agree that the information you provide is accurate and that we may contact you about your request. Our use of that information is described in our Privacy Policy.
Email. If you subscribe to our newsletter or marketing emails, you can unsubscribe at any time using the link in any email.
Text messages. If you opt in to text messages, you agree to receive recurring messages from ESCG at the number you provided, which may include appointment reminders, event and resource updates, and offers. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.
5. Intellectual property
The Services and their content, including text, graphics, logos, frameworks, videos, and downloadable materials, are owned by ESCG or its licensors and are protected by intellectual property laws. You may view and use the content for your personal, non-commercial use. You may not copy, resell, republish, or distribute it without our written permission.
6. Acceptable use
You agree not to misuse the Services, including by submitting false information, attempting to gain unauthorized access, interfering with the site's operation, scraping content, or using the Services for any unlawful purpose.
7. Third-party services and links
The Services may link to or use third-party websites, booking tools, podcasts, and platforms. We are not responsible for their content, policies, or practices.
8. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, ESCG and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or investment, arising from your use of the Services or reliance on any content. Our total liability for any claim relating to the Services will not exceed one hundred U.S. dollars (US$100) or the amount you paid us for the Services in the twelve months before the claim, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless ESCG from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Services or violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continued use of the Services after an update means you accept the revised Terms.
